Fidelity class action lawsuit alleges data breach caused by compromised customer data

Fidelity Class Action Lawsuit Overview:

  • Why: Yaakov Gluck and Steven Gluck allege that Fidelity failed to adequately protect its computer network from an August data breach that compromised customer data.
  • Where: The class action lawsuit was filed in federal court in Massachusetts.

Fidelity Investments failed to adequately protect its computer network during a “massive and avoidable” data breach in August, according to a new class action lawsuit.

The class action lawsuit filed by plaintiffs Yaakov Gluck and Steven Gluck alleges that the Fidelity data breach allowed cybercriminals to “steal everything they could possibly need” to commit “almost every conceivable” form of identity theft.

“Because Defendant represented such a soft target for cybercriminals, Plaintiffs were already victims of, or were at increased and imminent risk of, privacy violations, fraud, and identity theft,” the data breach class action lawsuit says.

The Glucks want to represent a nationwide class of consumers whose data was compromised during the data breach.

The data breach exposed Social Security numbers, financial information, names, phone numbers and addresses, the Fidelity class action lawsuit says.

Yaakov Gluck and Steven Gluck argue that Fidelity failed to take “appropriate and reasonable” measures to ensure that its computer systems were protected and failed to take reasonable steps to prevent and stop the breach.

The class action lawsuit further argues that Fidelity failed to timely detect the data breach and, among other things, failed to live up to its “repeated promises” to protect consumers’ personal information.

“As a result of the data breach, Plaintiffs feared the release of his personal information, which he trusted would be protected from unauthorized access and disclosure,” the data breach class action lawsuit states.

Yaakov Gluck and Steven Gluck accuse Fidelity of negligence and negligence per se and invasion of privacy. Plaintiffs demand a jury trial and seek declaratory and/or injunctive relief and an award of actual, statutory, and punitive damages for themselves and all Class Members.

A couple of consumers filed a lawsuit similar class action lawsuit Earlier this year against Fidelity over allegations that the company and its subsidiary LoanCare failed to properly protect and secure consumers’ personal information during a data breach announced by Fidelity in December 2023.
