Mitchell Towing & Recovery applies for conditional use permit after city warning – Mitchell Republic

MITCHELL – The Mitchell Planning Commission will consider a request for a conditional building permit from Mitchell Towing & Recovery at its meeting on Monday, Aug. 26.

The meeting is scheduled for noon in the City Council Chambers at Mitchell City Hall.

Company owner Josh Frost applied for a conditional building permit after the city sent him a letter informing him that it had received complaints regarding his property at 24994 406th Ave.

The property listed in the agenda is currently zoned for urban development. The complaints received indicate that Frost is using the property for purposes other than those intended.

“The complaints relate to your use of your property as a scrap yard (salvage), commercial outdoor storage facility, or outdoor storage facility. A scrap yard (salvage) is not a permitted or conditional use in this zone. Commercial outdoor storage facilities and outdoor storage facilities each require a conditional use permit within this zone,” the letter dated July 26, 2024, states.

The letter continued: “A significant amount of equipment, debris and salvaged material has been brought onto your property… and you are in violation of the City of Mitchell’s building code. Therefore, you must immediately apply for a Conditional Use Permit for Commercial Outdoor Storage and Outdoor Storage and immediately cease the car parking and junkyard (salvage) and develop a plan to avoid car parking or junkyards on the property.”

The letter also details the definition of a junkyard (salvage), commercial storage, and outdoor storage, along with example photos. It also states that if a conditional building permit is not applied for within 10 days of receiving the letter, the case will be forwarded to the city attorney for further processing.

The Commission is also expected to hold a rezoning hearing and recommendation for Dakota Land & Property Management, LLC, a zoning setback variance for Dennis Kaus, and a variance for Central Plains Automation, Inc.

The meeting on Monday, August 26, is public.
