Oasis fans can sue Ticketmaster over dynamic pricing, lawyers say

Richard Pike, partner at Fieldfisher, told The Telegraph that ticket buyers could join forces and file a class action lawsuit against Ticketmaster.

“They could be sued for violations of consumer protection laws, common law suits, misrepresentation,” he said. “There are all kinds of things they could do.”

“You would have to take a case to the Supreme Court. It works like the adverts on TV that say: ‘Have you had an accident? Have you bought a PPI?’, it would be like saying: ‘Have you bought an Oasis ticket at quite a high price?’

“In theory, you could do that. As for the advisability of such a measure, I think there are arguments.

“I don’t know about you, but I wasn’t expecting this dynamic pricing.

“I didn’t notice this until I had been on the phone for quite a while.

“You can see psychologically that there’s an obligation here. If you’ve waited that long, you’re willing to pay more than you otherwise would. They’re taking advantage of you.”

Mr Pike added that the failure of the claim would depend on the total amount of damages, which would be just a few hundred pounds per person and might not cover the costs of a lawsuit.

In contrast, joint PPI claims can result in damages of several thousand pounds per person.

Tickets for the Britpop band’s long-awaited reunion tour were only available through online ticket seller Ticketmaster, which increased prices due to high demand.
